Family situations change over time. This is true even after divorce. As children grow, changes occur that may require modifications to an original child custody or child support agreement. These changes must be approved by the court, even if they seem minor.

Post-judgment modifications become necessary if the circumstances of either parent or the child have substantially changed. Common reasons clients seek modifications to child support or custody include loss of job, illness or injury, or a significant change in income. However, the court is unlikely to change support payments if the loss of income occurred as a result of your choice or deliberate actions.

“When it comes to fighting for someone or something that means the world to you, it’s so important to have a fiercely competent attorney by your side. You have been this type of attorney for me. Without your representation I would have been pushed around without mercy. You have been the source of many nights of restful sleep for my daughter and me.” — Y.M

Making Changes To Custody And Visitation

Modifications also may result from significant changes to a child’s needs or due to relocation by the custodial or noncustodial parent. In custody and visitation matters, it comes down to the best interests of the child, just as it did originally. Custody or visitation rights may be changed if a parent engages in behavior that puts the child at risk.

If a parent relocates out of state, child custody and visitation orders may be modified. The court may reduce child support payments to make up for the cost of transportation for child visits, or change the visitation schedule from alternate weekends to longer visits during school breaks and the summer.

We also help with enforcement of child support or custody issues if a party is failing to comply with a court order.
