Child Support Modifications In Brooklyn, New York

Family Court magistrates determine the amount of child support the noncustodial parent will pay based on the parent’s adjusted gross income and on the number of children involved. Either parent can petition the court to modify child support if circumstances warrant. Reasons for modifying support payments include loss of job or promotion, decrease or increase in salary, or long-term changes in a child’s situation such as a chronic health condition that requires additional support.

The court multiplies the adjusted gross income by the standard guideline percentage for the number of children (child support calculator). These percentages are as follows:

  • 17 percent for one child
  • 25 percent for two children
  • 29 percent for three children
  • 31 percent for four children

If the child has proven special needs, or in cases involving substantial family assets, the court may order above-guideline child support without further reference to the percentage.
