Brooklyn Child Support Attorneys
If you are a parent, New York law says you are responsible for the financial support of your child until the child turns 21, even if you have never lived with the child or do not live with the child now. After divorce, the noncustodial parent will be responsible for paying child support to help pay for the needs and education of the child. Child support may include:
- Cash payments (based on the parent’s income and the needs of the child)
- Health insurance for the child (medical support)
- Payments for child care
- Payments for reasonable health care costs that are not covered by health insurance
- Extracurricular activities
- A portion of child care incurred to enable the custodial parent to go to work

Child Support Modifications In Brooklyn, New York
Family Court magistrates determine the amount of child support the noncustodial parent will pay based on the parent’s adjusted gross income and on the number of children involved. Either parent can petition the court to modify child support if circumstances warrant. Reasons for modifying support payments include loss of job or promotion, decrease or increase in salary, or long-term changes in a child’s situation such as a chronic health condition that requires additional support.
Our Lawyers Truly Understand Child Support Payments
The court multiplies the adjusted gross income by the standard guideline percentage for the number of children (child support calculator). These percentages are as follows:
- 17 percent for one child
- 25 percent for two children
- 29 percent for three children
- 31 percent for four children
- At least 35 percent for five or more children
If the child has proven special needs, or in cases involving substantial family assets, the court may order above-guideline child support without further reference to the percentage.
